I am not sure if any reputed lawyer is going to be able help. The fact that you agreed that you worked in a gas station when you were not suppose to causes a problem for a lawyer make a case. I am hoping one of the lawyers on this forum would be able to guide you on this.

Having 3 days left for your date to be current does not mean much if you are thinking of getting your GC on oct 1. Not everyone gets the GC as soon as the dates get current. Ask people whose dates became current in June. Have you also checked if your name check is cleared?

Actually it was before July 30 that you could send it to either service center, but like I said earlier, with all the internal transfering that's going on, hopefully you'll be ok.

While listing the house the seller signs an agreement with the agent that they would go thru that agent. So directly dealing with the seller may not be an option. Now, there are home selling agencies who charges a fixed amount ($3000). And some times the seller tries to sell the house directly; in that case they would not be able to list the house in the MLS. Hence many sellers do not go this route.

and the seller basically prices it into the sale price... which why when buying next time .. i would ask to deal with the seller directly.. get an attorney to do the paperwork and diligence for $600 and ask the seller to keep 1% and give me a 5% discount.lil leg work and you save like 25k on 500k house.

Thanks for this Jason. I've often wondered why Olympus and Pentax haven't stepped up and gotten in the dslr market with the other big boys. My first camera was a Pentax K1000 (which I still have) and it was great. When I first decided to get into the dslr game myself I was disappointed to find so few choices of manufacturers.
It's good to see Olympus getting in the game. They've always had a solid product and I'm sure they will work out their design flaws.

My followup qn to this is ..

If I get my 3yr H1 extn approved (before 140 cancellation) with company B and company A revokes my approved 140, is it possible to transfer my priority date(of the approved 140 ..which is now revoked by company A) to my new 140 filed by company B?

A priority date can only be recaptured from one approved I-140 to another approved I-140, regardless of whether an I-485 was filed or not.

The approved 140 were from different companies. I got the update in 2 days after my attorney responded to the RFE.

The backlog centers have 10 fed govt employees and 100 guys from Exceed unless I am egregiously mistaken.

Why does any one think that those 100 guys will be left out with out any jobs? Wont the 10 fed guys be moved to Chicago/Atlanta NPC's with huge reloc benefits package? If they dont choose to move because of personal reasons, Do you know what kind of severance packages they get?

100 guys from Exceed will be definitely working for other fed agencies after they are done with this gig. IRS has a huge base in Philly and Exceed is a govt contractor. May be IT consultants need to learn from these folks..

Ok .. let me give you the math before getting to the question: )

Looking at the numbers from USCIS: http://www.uscis.gov/USCIS/New%20Structure/3rd%20Level%20(Left%20Nav%20Children)/Green%20Card%20-%203rd%20Level/Pending%20Form%20I485%20Reports.pdf

140 k GC numbers every year
85% available for folks in US, which is 199k
Out of these 119 k visas available, 40k are Eb3 category ..
10% for country .. so India's numbers should be 4000 a year

There are 14000 Eb3 visas before mine
Out of these 4750 are from India

So maybe I get the GC in 1 year 2 months?
Starting from? next Oct 10, meaning GC in Dec 11?

7170 visa should be given this year with the Apr 01 cut off .. so roughly 7000 Eb3 visas available so in all probability I should get it next year Dec 10?

What is confusing is this?
As per the latest visa bulletin .. the Eb3 cut off for all countries is around jun 02
And there are about 14k eb3 numbers till Jun 02.. so isn't the cut off be something like Dec 03 .. as current date .. since that's what 40k GC numbers add to?
If 40k GC's available for Eb3 for 2009 ... why is the cut off date Jun 02 .. which accoutns for only 14k GC's?

No, a Canadian citizen cannot work in the US without a Visa. The options available are TN (Treaty Nafta) visa and H1-B for the average skilled worker. We (Canadians) are in the same boat with the Indians, Chinese, etc. awaiting our priority dates to become current. Mine is 01/11/02 so I have some hope that it will become current in the next year. Until then, I have to pay a premium for property taxes (no homestead exemption) on Florida's east coast.

Hopefully (wishful thinking here) CIR will move forward in the House. At the very least I would like to see family members exempt from the EB Visa count.

There is no limit on the amount of money that a person can bring in. However if a person is carrying $10 k (this includes cash, travellers check, bank draft etc) or >5k in cash then that has to be declared at customs and person should go through Red Channel.

Are there any fees that has to be paid when the amount is declared? And is this for visitors only?

Hi All,

Me and my wife are traveling to India. We are going for visa re-stamping (consular processing).

Based on the information provided below, can you provide lists of forms/docs that we're supposed to carry with us when we visit the consulate for stamping?

My visa:
- I entered on H1B. Then I had to change employer so visa was transfered (And they extended it for another 2.5years). So now I have a H1B visa which is valid till June 2009, and passport with expired H1B stamp.

- With the new employer - I've an approved PERM. I140 is pending. I485 is filed. EAD received. Do I need to take approval notices and/or receipt notices of any/all of these stages?

My Wife's visa:
- she entered on H4. Now she has a H1B visa which is valid up 2010, and passport with expired H4 stamp.
Is she required to take approval notices and/or receipt notices of i485.. or my PERM or i140?

First of all. there is no talk about re-capture bill anywhere along with the Dream ACt they does not even mentioned on the revised Dream ACT, so only way is persuade Senators/Congressmen and The President, and join along with IV in the campaigns. That is the maximum each one can do.

These responses are based on my experience:
Make sure you are counting 180 days after you get the EAD Card (based off the valid date on the EAD Card) - like my lawyer says, its USCIS and they have no clue as to what they are doing. In such an event, you will be fully covered.

You can work anywhere you want to. You can use EAD as your proof of status and eligibility to work. Note that, you should ensure that you get your EAD Card renewed very religiously. Any lapse in renewal could be effectively used against you. Oh, it is also called Work Permit and normally, the employer asks for it during filling up your I-9.

Besides that, you are not required by law to do anything more. You might get called for AOS interview where you might be asked questions about your employment (I never did). But that is just a formality. I have read in forums about filing AC21, but my lawyer said such things were optional (in my case since I joined the client from the service provider). You should chill out and enjoy the job. Good luck.
