Hi,
A couple of events are happening in my life now:
* My current L1-B expires in June
* I am getting married in April - So I am traveling to India in April, returning in May.
* My company is planning to apply for my L1-B extension.
* My future wife will try to get her L2 in April, after our marriage, planning to come with me in May.
I hear that i am not supposed to be traveling while the L1-B is being extended. I also hear that the consulate may reject L2 if the L1 is about to expire.
1. Are these above rumors true ?
2. Is there a problem if my company applies for my L1-B extension and I travel to India at the same time ?
Thanks

While Congress has the ultimate responsibility to determine immigration law, the American Immigration Council reminds the President that he has substantial authority to make fixes to the immigration system within the confines of current immigration law. From AIC director Ben Johnson: Ben Johnson, Executive Director of the American Immigration Council, noted upon release of the memo: Ultimately, responsibility for failing to reform our dysfunctional immigration system rests on Congress. However, it is rarely the case that a Presidents hands are tied by existing lawand where the President disagrees with current law, his or her policy choices regarding the implementation of...

From Greg Siskind's blog:
In its press release, USCIS did not state how cases filed and rejected on the 2nd are to be handled other than to say that properly filed applications would be accepted. This presumably covers the many cases filed after the second that were held, but it doesnt explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. Hopefully, again, USCIS will institute a process for such individuals to avoid being penalized.

I have H 1B VISA but never went to USA....
1) now if i want to go there... will there be any problem
2) if I want to apply for another VISA work or Tourist... will i get?
You should not have a problem getting a different visa to come to the US to work or visit, assuming you qualify for the new status. It's not unusual for someone to get a visa that they never use.

you are right buddy. My husband was telling me the same thing today. If they can do what they did today, they are capable of pulling any tricks on us. I have also lost trust in this system. I am now more scared than ever for some reason.
I don't feel good about the whole thing that happened today.

2010 census data is gradually being released and it should worry anti-immigrants, particularly the Republican Party which has tried to appease the Tea Party gods by embracing a xenophobic agenda. Here's the latest, courtesy of CSM: White Americans are still the majority in the United States, but theyre rapidly being overtaken by Hispanics, according to the latest Census Bureau report, and this could have important political ramifications. During the past decade, the Hispanic population in the United States grew 43 times faster than the non-Hispanic white population, the Census Bureau reported Thursday. Put another way, between 2000 and 2010 the...

I am not sure what is so important in this to answer.
As long as thay had sent the finger prints to you, you should be OK. There is no particular pattern in which they send the EAD cards. So, no body can answer your question about when will you get the EAD. Just pray and watch. If it is more than 90 days since you have applied for your EAD, then you may contact your local office to expedite the process.

Hello, could some one help to answer this question.
Can I work part time on EAD, while I-485 is pending, without loosing my status? What could be potential issues?
I want to go back to school and complete a master's degree.
Thanks

Is it possible to file H1B1 transfer without lawyer?
There is a desi consulting that says they will do H1B1 transfer without lawyer.
For premium processing, they charge a fee of $3500

Hey
I am in a weird situation. My spouse would be graduating from business school soon ( summer). I want my parents and my aunt & her daughter to attend the graduation ceremony. My parents have an appointment coming up this week for visa (Hyderabad consulate).
For my aunt (37 yrs - house wife, husband passed away recently) and cousin ( 14 yrs - attending school), is it wise for me to send visa papers? I am a PR. My aunt has son who just finished 12th class and waiting for admission letters from graduate schools in India.
Can he be included in the papers for visitors visa? Or is it risky for him to attend now?
They have a set of sponsor papers from her sibling who is a citizen. those papers include all three of them (son, daughter and mother).
is it possible for only 2 of them to attend( mother and daughter only) while the I-134 mentions all three of them?
Is there any way out of this?
Thanks for your help in advance!

I'm about to start reading British native Simon Winchester's 2003 bestseller Krakatoa: The Day the World Exploded about the massive Indonesian volcano. I've always had a fascination with natural disasters all the way back to writing a junior high school research paper on hurricanes when I was growing up in Miami. Winchester's book on Krakatoa and his 2005 book A Crack in the Edge of the World about the 1906 San Francisco earthquake have had great reviews and I'm looking forward to reading both. Simon Winchester is a noted journalist who is known for his work writing for The Guardian,...

I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129 and I worked part-time on a full-time LCA and I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.
