I applied EAD for me and my wife, yesterday.
When I check for the case status, it shows my wife EAD application as I131(advance parole) document.

I have complete I765 application with receipt still I guess I need to call them.
Is anyone in the similar scenarios?

Hi,
I am in the US on H-4 Visa.
I have MBA(marketing) Degree from India and 90 Hour Early Childhood Certification and CPR Certificate.
I have been offered a job for the position of LEAD KINDERGARTEN TEACHER in a private CHILD CARE CENTER in MD.
Query :
A) Does the above JOB qualify as H1B?
B) I checked on FLCDATACENTER to determine the prevailing wage for this job - All Industries Database has a higher preveiling wage than what I am offered. Can I use any other wage source?

I think answer is NO if you want to come back of L1A from B employer.
To be eligible for L1A, You need to be on outside USA payroll from B employer for atleast 1 year (from past 3 years).
With H1B, you will be on USA's payroll for that period.

my current situation is like this.
i have H1B with Company A and it is valid till next year but i moved to Company B past two years back i worked with them now no job he said he is terminating h1b, so can i stay with previous company A (once i get the job i can switch to him until then can i stay with there h1b or not) or i will be in illegal status plase help me out.:confused:
and what actually be the Termination process of h1b

I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.
So I would like to know the options that I have to get my visa status changed to H1b.
1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?
2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?
Please kindly reply to my questions.

1) I am in USA on H1B.
2) I have accepted an offer to join companyA in January '07. They have filed for the H1B transfer a few days back. And I have resigned from my current employer.
3) Now another companyB has agreed to acquire companyA, and they will close the deal in December '06. CompanyB will be issuing revised offer letters to new hires like myself soon.
So even when my H1B has been filed by CompanyA, it will cease to exist on my joining date (January '07).
My question is how is the H1B handled in such a case ?
Can an amendment be sent to the original application saying its for CompanyB, and not CompanyA. Or does CompanyB have to apply for a fresh H1B ?
General qn : When can I change the employer -- when the H1 papers reach INS or when the lawyers get the receipt notice from INS ?
They are setting up conference calls with the lawyers soon; I was wondering if I could get some inputs from the experts on the forum as well.

I was working for company A in US till June 2008. I had to return to India in July 2008 due to personal reasons. My 6th yr on H1b expired in October 2008.
I am now in India and applying for 3yrs H1b extension based on my approved I140 with company B. My I485 was filed in august 2007. I do not have US pay stubs since July 2008 as I did not work in US.
Has anybody been in a similar situation? What are the chances of getting approval? Once I get I797 approval, should I expect further challenges in getting visa stamped in India?
