People who got GC are not facing any waves. That is why we need to get GC asap. Well, why is there 33% quota for EB1,2 and 3 in the first place. They could have very well made it 100% for Eb1 and if there was any spill over, EB2 gets them and then finally EB3! Because, US needs people from all categories.
Now all that I am saying is there should be some % on the spill over that comes from EB1.
If there are 300,000 applicants in EB2 and if the spill over from EB1 is 30K every year, you think it is fair that EB2 gets that for over 6-7 years without EB3 getting anything? That is not fair and if that's what the law says, it has to be revisited. I am saying give 75% or even 90% to EB2 and make sure you clear EB3 with PD as old 2001 and 2002. That is being human. They deserve a GC as much as an EB2 with 2007 (and I am not saying that EB3 2007 deserves as much as an EB2 2007).
Bottom line, EB3 (or for that matter any category) can't be asked to wait endlessly just because there are some smart kids in another queue! We can come up with a better format of the letter; we can change our strategy to address this issue; we do not have to talk about EB2 and mention only our problems. We want EB3 queue to move.

please forgive my ignorance and I have asked this question 2-3 times on this thread itself.
Do you think if Obama comes into power then all the people who are waiting for GC under employment based GCs will loose thier current applications and will have to start all over again in the new Point based system or the new point based system would only be for new applicants? It might very well be possible that Obama campaigns for Recapturing the lost visas and reducing the current backlog quickly so that the new process can be in placed quickly...I doubt that all the pending applicants will be asked to join the new point based queue, because no one would be willing to do it and a lot of people will be going back to thier home country and there would be a lot of crisis specially in IT as he is also campaining for Less H1B, so companies will not be able to hire new H1B.

To hear the candidates in this presidential campaign, you'd think lobbying is just one notch below waterboarding, a black art practiced by the great malefactors of wealth to keep the middle class in a vise and loose upon the nation every manner of scourge: oil dependency, greenhouse gases, unpayable mortgages and those tiny entrees you get at French restaurants.
Lobbying is constitutionally protected, but that doesn't mean we have to like it all. Let's agree to frown upon bad lobbying, such as getting a tax break for a particular industry. Let's agree to welcome good lobbying -- the actual redress of a legitimate grievance -- such as protecting your home from being turned to dust to make way for some urban development project.
There is a defense of even bad lobbying. It goes like this: You wouldn't need to be seeking advantage if the federal government had not appropriated for itself in the 20th century all kinds of powers, regulations, intrusions and manipulations (often through the tax code) that had never been presumed in the 19th century and certainly were never imagined by the Founders. Now, one of the roles of Congress is to make sure that said bureaucrats are interpreting and enforcing Congress's laws with fairness and dispatch. All members of Congress, no matter how populist, no matter how much they rail against "special interests," zealously protect this right of oversight. Therefore, one of the jobs of the chairman of the Senate Commerce Committee is to ensure that the bureaucrats of the FCC are doing their job.
What would constitute not doing their job? A textbook example would be the FCC sitting two full years on a pending application to acquire a Pittsburgh TV station. There could hardly be a better case of a legitimate "petition for a redress" than that of the aforementioned private entity asking the chairman of the appropriate oversight committee to ask the tardy bureaucrats for a ruling. This, of course, is precisely what John McCain did on behalf of Paxson Communications in writing two letters to the FCC in which he asked for a vote on the pending television-station acquisition. Which is why what was intended to be an expos¿ turned into a farce, compounded by the fact that the other breathless revelation turned out to be thrice-removed rumors of an alleged affair nine years ago.

Do you really think they would send the G-325a to the consulate? Do the consulates keep all the records? For how long? I heard from immigrationportal, somebody said they only send G-325a to the consulate if one applied a visa within one year prior to AOS application. Can anyone confirm this?
If they send everyone's G-325a form to the consulates, would that result in another backlog? Thanks.
This is really a grey area, as per the field manual visa's issued by consulate/embassies less than a year are verified or checked. Less than a year is because the dept of states purges data a year old thats why less than a year time frame they send the copy to consulate for checks . But the grey area I am talking about is ,lets say i applied for 485 in july 2007 and i got my H1 stamped in sept 2006 by the time my case is processed it will be most probably oct 2007 (liek data fed in etc) now in oct 2007 when they process the checks DOS would have purged the data ,so in turn when they process your checks yourr visa issuance date shoudl be over a year as the consulates and embassies wil purge data one year old. I am talking about normal cases where visa stamping is very straight forward ,revalidation or extension etc.

Its important to understand the root cause for the retrogression. Illegals dont have categories and categories in the EB GCs are there for a reason. It makes a world of a difference for somebody who is EB2 or EB3 if the person was from say.. Bangladesh. If EB2 he is all set if EB3 he will be languishing here. I am EB2 and am in trouble because of CONSULTANTS and yes I have a problem with that.

There are certain members who are intransigent about their support for the Durbin-Grassley bill.
Majority of them are supporting Durbin-Grassley not because they believe that consulting a lower kind of work compared to full-time employment but because they have themselves never felt the need for consulting companies.
Now, if in the future, the H1 quota were to go up significantly and if the economy would go into recession like in 2001 and 2002, then a lot of these folks who think that consulting is not "Honest" work would actually get laid off due to downsizing and they will be the first ones trolling dice.com to get a H1 quickely. And in those times, only the consulting companies will do an H1 transfer and save their asses from getting out of status and out of country. At such a point in time, the highly elite people here on this forum who think that consulting is not "honest and hard work" and only full-time employees are the real workers will have a very very different view of Durbin-Grassley bill.
The good times and good economy offers us luxury of slinging mud on the lesser mortals in consulting jobs but bad times in economy can put you right at the place where you are slinging mud.
So if you get your GC without ever needing to beg a consulting shop to quickely get you an H1 transfer to change your status during layoff season and economic recession, then good for you. I agree, the conflict discussed here is a political conflict. It could have been resolved much easier if all sides stopped looking at it with the religious-end-of-times lens (jews: nile-to-euphrates empire belonged to us 3000 years ago, christians: jews from all over the world must be transfered back there for the messiah to return.. and muslims: end of times won't come until jews fight the muslims and we beat them)

I would think there would be a lot of pissed off countrymen in India who would scream at you when you are ignoring real issues and focussing instead on giving green cards to foreigners especially when you already have a sky high unemployment rate. Wouldn't be a great political strategy, would it? But maybe you would still do it, perhaps if you have a vested interest in getting it done.

Per my understanding, it absolutely is. An LCA amendment has to be filed each time there is a location change outside of commutable distance from the original location for which the H-1B was filed.

Indeed! But if the individual 'affordability' is such that you can pay the monthly payments even after moving out of US due to job loss/485 denial, and if the purchase lowers your tax bill, then it may make more sense to buy the house...
Personally, I've always had intentions of buying real estate in US, EU and India.... have it in India, considering it in US and exploring how to buy it in EU... :) Wish had much more 'cash'... :D

That is a nightmare !!! unless you are bill gates, Tata, Ambani etc etc ..if u have a relative in US in the same location then maybe you can manage but still it is problematic ..on top of it, how do you earn money in say India to pay mortgage in US ??
if my GC (or say residency in any country) is denied, I would not want any immovable property in that place ....break - ins, mntc problems, maintenance etc ..I know there are some agencies which will take care of the property for you but their fees are high. I would rather have my money in liquid form and take it with me (or have the ability to take it with me).
as someone else said ..maybe an option would be to stay back and sell the house (at a loss I guess) ..and risk going out of status (but re-entry would be problematic).

This person hiding behind the user id "Rolling_Flood" is an extreme selfish person. The whole idea of our community is to help each other and to provide support & guidance to each-other. Instead he is trying to stop others from getting this advantage, trying to make us believe that EB-2 is his birth-right. I am in EB-2, but I do not support this selfish fox, he will harm the IV community exploiting 'divide & rule' policy. :mad:

This guy "Rolling-flood" has not contributed anything positive like lobbying for removing country quota and recapturing of un-used visa numbers, instead he actually wants to cut the line by stopping others taking the same advantage that he is trying to take. If such rules are not there, no one needs to do pd recapturing or changing categories. I have my juniors with less educational qualification, from my neighboring countries who started the process and got GC in less than 16 months straight. isn't that injustice to me - did I have choice to select my country of birth?

What I take from your reply is that if the company is on their radar (for reasons that they will never disclose or we will never know - but we can assume some kind of fraudulent activity - like what you suggest too many h1's etc) they can (and currently are for h1 applications) apply all of their might to deny applications.
Most of us have become pompous and are living in a big bubble. We think that since we pay taxes we are special. I cant imagine how out of touch with reality we are ....when I see postings like these for example remove EB1/EB2/EB3..whatever classification quota since we "the special class" of people are suffering, remove per country limit since we have paid taxes for 10 years, we will solve the housing crisis if we get gc's, we are responsible for creating innovation, progress and jobs (though i agree small percentage of the total pool may well be responsible for some innovation but not all), we are some sort of super humans , calling up senators/congressman - wont they be more interested in protecting their constituent's -- who I hate to say is not us (that is would be immigrants)

The recent uprisings in Tunisia, Egypt, Libya and elsewhere in the Middle East have important consequences for China’s foreign relations.
With Washington becoming increasingly preoccupied with the Middle East, it will have less opportunity to focus on China. At the same time, the return of a US policy aimed at promoting democratisation could have a destabilising effect on Sino–US relations. China might reassess how it shapes its relations with highly repressive regimes, and it will have to take into account that Western countries are now better positioned to push resolutions aimed at intervening in certain types of countries through the UN Security Council (UNSC).
The uprisings run counter to assumptions that the predominant struggle in Middle Eastern politics is between US-backed authoritarian regimes and Islamic fundamentalism. Instead, the recent revolts involve a third force — the ‘urban underdogs.’ These popular movements are largely disorganised, have no leaders and are not based on clearly defined ideas. The uprisings are the outcome of poor economic conditions, the authoritarian suppression of fundamental liberties, and the highly corrupt nature of the ruling elite. Situational factors also play a role: the spill over effect from revolts in one country to the next; the availability of modern forms of communication to enable mobilisation; the use of symbolic places for mass gathering (in the case of Tahrir Square in Cairo); overwhelming attention from the West; and the policy inclinations of the US and European governments.
As the Arab world transforms, becoming more tumultuous along the way, Washington will face new dilemmas, and the fight against terror will no longer be overwhelmingly dominant. ‘Pushing democracy’ has returned as a major foreign policy theme in Washington as the uprisings partially restore the West’s self-confidence, battered from the financial crisis.
All of this has major implications for China’s foreign relations. Washington’s deeper involvement in the Middle East is favourable to Beijing, reducing Washington’s ability to place focused attention and pressure on China. But, conversely, the partial return of the push for democracy is not to the benefit of China or stable Sino–US relations. China may need to reconsider its quite amicable relationships with regimes that are repressive, corrupt and have little popular support. Beijing is insufficiently prepared to deal with dramatic political changes in such countries, clearly shown in the past when China’s relations with Iran (1979), Romania (1989) and Serbia (1999) were severely affected. This happened more recently in Zimbabwe, and now also in Egypt and Sudan. Other countries where similar developments could take place are Burma, North Korea and perhaps also Pakistan.
The Middle Eastern turmoil is also relevant to China’s domestic stability. Some activists in and outside China are hoping for a ‘Chinese jasmine revolution.’ Beijing overreacted somewhat, particularly in the early days, by taking strong domestic security precautions despite no signs of widespread activism in China. This may have been the activists’ immediate purpose: to embarrass the Chinese government and to show its lack of self-confidence to the world and the Chinese public. This in turn could make Beijing more hesitant about deepening economic and political reforms.
The uprisings are also affecting China’s international position with regard to the issue of intervention. Beijing probably believed they had no choice other than to allow the UNSC to adopt Resolution 1973, which gave the international community the authority to establish a no-fly zone over Libya. It was clear that the US, France and the UK were resolutely determined to launch a military strike, and certain Arab and African countries supported and even intended to join the intervention. Had Beijing vetoed the resolution, China’s relations with both the West and the Arab countries involved would have been severely strained — and the West would have still launched their attack anyway. This was a hard decision for China: Resolution 1973 could form a dangerous precedent in international law, as previous norms have been revised in favour of armed intervention in a domestic conflict. In the future, the US and its allies might reapply this, potentially to the detriment of China’s interests.
China’s hope for stable Sino–US relations following the state visit of Chinese President Hu Jintao to the US in January 2011, and China’s important relationship with Saudi Arabia, had induced Beijing to abstain from using its veto in the UNSC. Moreover, if a similar case does occur in the foreseeable future, it seems rather unlikely that China or Russia would use their veto in order to protect the principle of non-interference. Consequently, the US and its associates in the UNSC might very well see an opportunity to act resolutely in the coming years, with the aim of effecting intervention in other countries, comparable to Libya, a country first of all not allied with them and far distant from them. This is an opportunity that has likely not escaped Washington’s attention.
